Overnight Respite in Certified Adult Day Care Programs Rules

The Department of Health and Human Services was directed to pilot an overnight respite program in facilities offering adult day care programs by Session Law 2011-104 (Senate Bill 512) with a repeal date of June 1, 2015 for the act. Rules for the pilot program were developed in response to this law with the establishment of a new Subchapter entitled "Overnight Respite in Certified Adult Day Care Programs" in 10A NCAC 14D. Session Law 2015-52, s.2 (Senate Bill 291) amended the act repeal date by extending it to June 30, 2017. These rules are proposed to be repealed, as the repeal date by the General Assembly in the act deletes the underlying authority for these rules.
