Adult Care Home and Family Care Home Rules

Pursuant to GS 150B-21.3A, Periodic Review and Expiration of Existing Rules, all rules are reviewed at least every 10 years, or they shall expire. As a result of the periodic review of Subchapters 10A NCAC 13F, Licensing of Adult Care Homes of Seven or More Beds, and 10A NCAC 13G, Licensing of Family Care Homes, these proposed rules were part of the 97 total rules determined as “Necessary With Substantive Public Interest,” requiring readoption and amendment. At this time, seven rules for the Licensing of Adult Care Homes of Seven or More Beds are proposed for readoption and one rule for the Licensing of Family Care Homes is proposed for readoption. In addition, five rules are proposed for adoption and one rule is proposed for amendment for the Licensing of Adult Care Homes of Seven or More Beds and one rule is proposed for adoption and one rule is proposed for amendment for the Licensing of Family Care Homes.

The agency is proposing changes to clarify management and staffing requirements for licensed adult care and family care home facilities. Technical changes had been made to remove requirements based on capacity or census to using only the census to determine management and staffing requirements. The proposed language reorganizes the rules to delineate management responsibilities from management and staffing requirements.
